The Terms and Conditions (“Terms”) are meant as a help for you to understand and abide to the intentional use of the Saphe websites, webshop, devices, apps, and other services (“Services”). Please read these Terms carefully and contact us if you have any questions.
1. PERSONAL DATA
By using the Services, you accept these Terms. Consequently, these Terms constitute a binding agreement between Saphe A/S (“Saphe”), including its affiliates and subsidiaries, and you as the user of the Services.
The Services may only be used by individuals who can form legally binding contracts under applicable law. The Services are not intended for minors. By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into and abide by these Terms.
3. PROPRIETARY RIGHTS AND LIMITED LICENSE
Any content of our Services, hereunder design, infrastructure, data, software, and code are proprietary to Saphe or our suppliers.
Saphe grants you a non-exclusive, non-transferable license, revocable at any time at our discretion, to access and use our Services according to the Terms. Use of the Services does not grant you any intellectual property rights in or to any information or content in the Services.
4. USING THE SERVICES
Saphe offers a market-leading platform for community-based sharing of traffic alarms and related services to improve road safety, save time, and avoid fines. The purpose of our Services is as described in our webpages, apps, and the Terms, and may change with or without prior notice.
You agree in the use of the Services to comply with the Terms and any applicable laws in the country in which you use the Services, to use the Services only for your private and personal purposes, not to use the Services outside the intended purpose, and abide all necessary consent before submitting any information as a part of the Services.
You agree to not use the Services commercially. For example, you cannot: offer a third party a separate service that uses the Services; resell the Services; offer to rent or lease the Services or offer the Services to the public through communication or integrate it into a separate service without the prior written consent of Saphe.
You agree in the use of the Services not to perform any activities that may harm the Services, Saphe, or other users. You must not copy, print, save, or otherwise use data from the Services’ database. When using the Services, you should not be engaged in “scraping”, data extraction, data harvesting, “screen scraping”, data aggregation, and indexing. You agree that you will not use any robot, spider, “scraper” or other automated means to access the Services’ database without the explicit prior written permission of Saphe.
The above-mentioned guidelines serve as an example and do not constitute a complete list of restrictions for using the Services. This provision does not limit the intended private and personal use of the Services.
Some devices may contain a region lock, and this will be written explicitly on the accompanying sales packaging or similar. A region lock will limit the device usage outside the designated region to a total of 90 days a year and a maximum of 30 consecutive days. The 30-day consecutive period is reset if the device is returned to the designated region for a period of 7 consecutive days.
In the use of the Services or parts thereof, you may be required to register as a user and create a user account with a username and password and you may need to provide us with certain personal information and consents to data processing for us to be able to provide certain of our Services. You will be requested to provide such specific consent during the registration process.
You may terminate your registration at any time if you do not wish to use the Services.
You agree to provide correct and complete information in the registration.
The data manager at saphe.dk is Freddy Sørensen, CEO. As registered with Saphe A/S, you always have the right to send us your objections to the registration. You also have the right to insight into what information is recorded about you. You have these rights under the Personal Data Act. Inquiry in this regard is sent to email@example.com
Saphe A/S receives payment via VISA, Paypal or MasterCard. Payment will only be charged to your account when the item is shipped. All amounts are in EUR and are incl. VAT if not stated otherwise. Saphe uses an approved payment server that encrypts all your card information with SSL (Secure Socket Layer) protocol, which protects your information.
Saphe A/S usually sends out all orders received before 15.00
Packages are usually delivered in 4-6 days.
We also supply to non-bridge connected islands. The same terms of delivery apply.
Consumers are given 2 years of right to a complaint in accordance with the Purchasing Act’s deficiency rules. Our right of complaint applies to defects in material and/or fabrication. The complaint does not apply to errors or damage caused by incorrect operation of the product/service. If your complaint is justified, it means that you can either get the item repaired, exchanged, money back or a discount in price, depending on the specific situation. You must return within “reasonable time” after you discover the error. If you contact us within two months after the error is detected, the complaint will always be timely.
Saphe A/S will cover return costs to a reasonable extent. The item must always be shipped back in proper packaging and remember to get a receipt for shipping so that we can reimburse your shipping costs. If you want to return the product due to technical challenges, we recommend contacting customer service before returning the product, as they can usually help you find a solution.
If the item is returned, please attach a description of the problem. Please describe in detail what you did when the error occurred.
If there is a refund, please send us your bank details so that we can transfer the agreed amount.
Consumers are given 60 days full return on goods purchased in our webshop. The period is counted from the day you receive the order. You must bear the return costs yourself, and you are liable if any damage occurs during transport. Cancellation must be notified to us within 60 days of purchase and from the cancellation, you must return within 30 days of returning the shipment. The notification must be given per. email at firstname.lastname@example.org or by using the standard cancellation form, which you will find at the bottom of the terms and conditions. In the notice, you must clearly indicate to us that you wish to exercise your right of withdrawal and to describe the condition of the goods when you return it. You cannot cancel the purchase by refusing to receive the item without notifying us at the same time.
If you purchased several items from us, you have the option to return one or more items, even if they were purchased in one order. Please note that you will not receive shipping costs if you cancel part of your purchase.
The state of the product when returning
You are only liable for any deterioration in the value of the product due to handling other than what is necessary to determine the nature, properties, and manner of operation of the product. In other words, you can try the item in the same way as if you tried it in a physical store, but you must not put it into actual use. If the item is tried in addition to what is described above, we consider it used, which means that upon cancellation of the purchase you will only receive part or none of the purchase amount, depending on the trade value of the item. We recommend that you return the item in its original packaging. If the original packaging is missing, it may result in an impairment of the product.
Refund of purchase
If you regret your purchase, you will get your money back. If the item is impaired, we will deduct the amount you are liable for. We will refund all payments received from you, including delivery costs (except for additional delivery costs in cases where you have chosen a different form of delivery other than the cheapest form of standard delivery we offer), within 14 days of the day we received it your message that you want to cancel the agreement. We will refund the money with the same payment method you used for the purchase unless we have agreed otherwise. We can withhold payment until we receive the item unless you send us documentation to have it returned.

You may also cancel the purchase by notifying us and delivering it in person at the above address to prior arrangement. We do not receive parcels without distribution or parcels sent by mail COD (Collect on Delivery).
If you want to complain about your purchase, you must contact Saphe A/S by e-mail; email@example.com or on tel;+45 42 90 33 11. If we are unable to find a solution, you can also use the European Commission’s online complaint portal, which will, however, mainly be relevant if you are a consumer domiciled outside Denmark. The Services are provided “as is”. Saphe does not in any way warrant the Services will be fit for your purpose or be free of errors or interruptions.
You agree that the use of the Services is at your sole risk, and Saphe is not liable for any direct or indirect damages or losses resulting from the use or the inability of use of the Services.
You agree to defend and indemnify Saphe from all third-party claims and other liabilities or losses resulting from your breach of the Terms, your infringement of any intellectual property rights, or any use or misuse of the Services.
Saphe may assign its rights and obligations under the Terms to any company under common control with Saphe. Saphe may furthermore assign its rights and obligations to a third party in connection with a merger, acquisition, sale of assets, or otherwise.
16. CHOICE OF LAW
The Terms are governed by the laws of Denmark without any regard to its conflicts of law’s provisions.
17. CHANGE IN TERMS
Saphe may change the Terms at any time without notice.
