The Terms and Conditions ("Terms") are intended to help you understand and consent to the deliberate use of Saphe’s website, webshop, devices, apps, and other services ("Services"). Please read the Terms carefully and contact us if you have any questions.

  1. PERSONAL DATA

By using the Services, you accept these Terms. These Terms constitute a binding agreement between Saphe A/S ("Saphe"), including its affiliates and subsidiaries, and you as a user of the Services.

  1. AUTHORITY

The Services may only be used by individuals who can enter into legally binding contracts under applicable law. By using our Services, you warrant that you are capable of complying with these Terms.

  1. PROPERTY RIGHTS AND LICENSE

All content in our Services, including design, infrastructure, data, software, and code, belongs to Saphe or our suppliers.

Saphe grants you a non-exclusive, non-transferable license, which can be revoked at our discretion at any time, to access and use our Services in accordance with the Terms. Use of the Services does not grant you any intellectual property rights to any information or content in the Services.

  1. USE OF THE SERVICES

Saphe offers a market-leading platform for community-based sharing of traffic alerts and related services to improve traffic safety, save time, and avoid fines. The purpose of our Services is as described on our websites, apps, and Terms, and may change with or without prior notice.

By using the Services, you agree to comply with the Terms and any applicable laws in the country where you use the Services, to use the Services only for your private and personal purposes, not to use the Services outside of the intended purpose, and to obtain all necessary consents before providing information as part of the Services.

You agree not to use the Services commercially. For example, you may not offer a third party a separate service that uses the Services, resell the Services, offer to rent or lease the Services, or offer the Services to the public through communication or integrate them into a separate service without prior written consent from Saphe.

You agree not to engage in activities that may harm the Services, Saphe, or other users when using the Services. You may not copy, print, store, or otherwise use data from the Service’s database. When using the Services, you must not engage in "scraping," data extraction, data harvesting, "screen scraping," data aggregation, and indexing. You agree not to use any robot, spider, "scraper," or other automated means to access the Service’s database without express prior written permission from Saphe.

The above guidelines serve as an example and do not constitute a complete list of restrictions on the use of the Services. This provision does not limit the intended private and personal use of the Services.

  1. REGISTRATION

When using the Services, or parts thereof, it may be necessary for you to register as a user and create a user account with a username and password, and you may need to provide us with certain personal information and consent to data processing so that we can provide certain of our services. You will specifically be asked to provide such consents during the registration process.

You can withdraw your registration at any time if you do not wish to use the Services.

You agree to provide accurate and complete information during the registration process.

  1. PRIVACY

Our Privacy Policy describes our processing of your personal data. By accepting the Terms, you automatically accept our Privacy Policy.

The data controller at Saphe A/S is Freddy Sørensen, CEO. As a registered user with Saphe A/S, you always have the right to send us your objections to the registration. You also have the right to see what information is registered about you. You have these rights under the Danish Data Protection Act. Inquiries should be sent to: info@saphe.dk.

  1. SUBSCRIPTION

The following applies to our Saphe Premium subscriptions:

Payment

Saphe A/S accepts payment for subscriptions with Dankort, VISA, MasterCard, or via MobilePay. All subscriptions are prepaid and always debited on the date they were created.

The subscription continues automatically until terminated, and in case of termination mid-subscription period, the amount will not be refunded.

Become an Annual Member and Get a Discount

By choosing an annual membership, the monthly price becomes lower. If you are currently a monthly member, you can change your membership to an annual one at any time and vice versa. Contact our customer support at +45 42 90 33 11.

Cancellation

For your purchase of the Saphe Premium subscription, a statutory right of withdrawal of 14 days applies from the time you receive a receipt from Saphe A/S. However, you can only use your right of withdrawal if you have not yet used your membership. If you wish to exercise your right of withdrawal, you must notify Saphe A/S within the 14-day period.

Termination

All subscriptions can be terminated at any time to the end of the prepaid period. Termination must be done by contacting our customer service at +45 42 90 33 11 or on club.saphe.com.

Price Changes

As we add more new features and data, subscriptions and prices may change. We may also adjust subscriptions and prices in connection with local market changes such as changes in local taxes or inflation.

When we change subscriptions or prices, we always work to improve the Saphe experience and invest in quality data and services for our subscribers worldwide.

If your price changes, Saphe will send you a notification in the app with information about the price change at least 30 days before the billing date when the price increases.

From August 23, 2023, we sent a notice about a price change. This notice was removed from the Saphe Link app on October 24, 2023.

  1. CAMPAIGNS

Saphe A/S occasionally conducts subscription campaigns. The purpose is to attract new customers, which is the basis for continuing to operate and develop our services. These campaigns may include a particularly advantageous introductory price. The campaigns are aimed at new customers, and we will send one or more emails about the campaign’s value proposition.

  1. DISCLAIMER

The Services are provided "as is." Saphe does not in any way guarantee that the Services are suitable for your purpose or free of errors or interruptions.

You accept that the use of the Services is at your own risk, and Saphe is not responsible for direct or indirect damages or losses resulting from the use of or inability to use the Services.

  1. LIABILITY

You agree to defend and hold Saphe harmless from all third-party claims and other obligations or losses resulting from your non-compliance with the Terms, your infringement of intellectual property rights, or any use or misuse of the Services.

  1. RIGHTS

Saphe may assign its rights and obligations under the Terms to any company under common control with Saphe. Saphe may also assign its rights and obligations to a third party in connection with a merger, acquisition, sale of assets, or other transactions.

  1. CHOICE OF LAW

The Terms are governed by Danish law without regard to its conflict of law provisions.
