Terms and Conditions

These Terms & Conditions apply from 7 April 2026 for new customers. For existing customers, they take effect on 10 May 2026. If you do not wish to accept the new terms, you may cancel before 10 May 2026. The previous version can be viewed here.

Introduction

These Terms & Conditions describe the services we provide to you, what they cost, how changes to the terms are handled, and how subscriptions are automatically renewed. We recommend that you read the terms carefully.

The Terms & Conditions, hereinafter referred to as the 'Terms', are intended to help you understand and agree to the use of Saphe's website, web shop, devices, apps and other services (collectively referred to as the "Services").

Please read the Terms carefully and contact us if you have any questions.

Who We Are and What the Agreement Covers

Saphe A/S, with registered address at Gasværksvej 46, 9000 Aalborg, Denmark ("we", "us" or "Saphe"), offers a range of services, features, content, websites and apps, delivered together with a Saphe device and associated charger or power supply (the "Saphe Device"). The Services and the device together constitute the "Services".

1. The Agreement

By using the Services, you accept these Terms. These Terms therefore constitute a binding agreement between Saphe A/S ("Saphe"), including its affiliated companies and subsidiaries, and you as a user of the Services.

The agreement applies to both current and future updates of the Service, cf. clause 12.

2. Authority

The Services may only be used by individuals aged at least 18 (or aged 16–18 with a valid driving licence) who are capable of entering into legally binding contracts under applicable law. By using our Services, you warrant that you are able to comply with these Terms.

3. Proprietary Rights and Licence to Use

All content in our Services, including design, infrastructure, data, software and code, belongs to Saphe or our suppliers. Saphe grants you a non-exclusive and non-transferable licence to use our Services in accordance with the Terms; this licence may be revoked at any time. Use of the Services grants you no further rights, including no intellectual property rights in the Services or any information or content within the Services.

4. Use of the Services and User Obligations

This agreement applies to any use of the Services, regardless of whether you have purchased a membership or subscription directly from Saphe, received it as a gift, purchased it through an authorised retailer or marketplace, or obtained it free of charge, for example via a trial period.

"You" or "your" refers to the person using the Services. If you create an account on behalf of a company, organisation or other legal entity, the agreement applies both to you personally and to that entity. You also declare that you have authority to enter into the agreement on behalf of the entity.

By using the Services, you accept these Terms. If you cannot accept them, you must not use the Services.

Saphe may amend the Terms when necessary. Material changes will be notified with reasonable notice of at least 30 days, in accordance with applicable EU consumer rights.

In the event of material changes, you have the right to terminate the agreement and receive a refund of the unused portion of your subscription. If you continue to use the Services after the change takes effect, this will be regarded as acceptance of the updated Terms.

4.1 General Obligations

By using the Services, you agree to:

  • Use the Service in accordance with this agreement and applicable legislation.

  • Refrain from misusing the Service, including refraining from circumventing security measures, refraining from sharing your login credentials with unauthorised parties, and refraining from using the Services for unlawful purposes.

  • Ensure that your payment and membership account details are always accurate and up to date.

  • Notify Saphe immediately if you become aware of any unauthorised use of your account or any security breach.

Saphe reserves the right to suspend or close your account in the event of a breach of these obligations.

4.2 Restrictions on Use

The purpose of the Services is as described on our websites, in our apps and in these Terms, and may change with or without prior notice. The Services may only be used for private and personal purposes.

By using the Services, you agree not to:

  • Use the Services commercially, including reselling the Services, renting or leasing the Services, or integrating them into another service without prior written consent from Saphe.

  • Carry out activities that could harm the Services, Saphe or other users of the Services.

  • Copy, print, store or otherwise use data from the Service's database for any purpose other than your own private use.

  • Engage in scraping, data extraction, data harvesting, screen-scraping, data aggregation or indexing, or use robots, spiders, scrapers or other automated means to access the Services' database without the express prior written permission of Saphe.

The above guidelines are examples and do not constitute an exhaustive list of restrictions on the use of the Services.

Safety

By agreeing to these Terms, the user undertakes not to allow the Service to distract them while driving, and not to hold the Service liable in this regard. The user also undertakes to comply with applicable road traffic legislation and acknowledges that alerts from the Service may be incomplete or delayed.

4.3 Continued Support

Use of the Saphe Service requires a compatible smartphone and/or tablet and the latest version of the Saphe app.

Saphe may discontinue support for older device models and app versions. In such cases, it may be necessary to upgrade the device or app in order to retain access to the Services.

5. Registration

When using the Services, or parts thereof, it is necessary for you to register as a user and create a user account with a username and password, and you may also be required to provide us with certain personal information and consent to our processing of such data so that we can deliver certain of our Services to you. You will be specifically asked to provide such consents during the registration process.

You may withdraw your registration at any time if you no longer wish to use the Services. You accept and undertake to provide accurate and complete information during the registration process.

6. Personal Data and Confidentiality

In order for you to use our Services, Saphe needs to collect, use and store certain personal data about you. We respect your right to privacy and prioritise the protection of your information.

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable data protection legislation.

If you have questions about the processing of your personal data, or wish to exercise your rights, you may contact our Data Protection Officer, Søren Vesti Lassen, at privacy@saphe.dk (please state "Privacy" in the subject line).

6.1 Third-Party Providers and Licences

The Service may include data and content from third-party providers, including map data, speed camera information and software components, including open-source software. Use of the Service may be subject to additional terms from the Apple App Store, Google Play Store or other third-party platforms. Saphe is not responsible for changes, errors or unavailability in third-party services.

7. Liability and Disclaimer

Use of the Service and Road Traffic

The Service must not distract you while driving. You must always comply with applicable traffic regulations. Alerts and information delivered via the Service are advisory and may be incomplete or delayed. Saphe cannot be held liable for any incidents resulting from the use of the Service while driving.

Limitation of Saphe's Liability

You accept that use of the Services is at your own risk. Saphe is not liable for direct or indirect losses, loss of business, loss of profit, loss of data or other consequential losses, unless otherwise required by mandatory legislation. Nothing in these Terms excludes or limits Saphe's liability in situations where such liability cannot lawfully be excluded, including liability for intentional or grossly negligent conduct, personal injury, or liability under applicable product liability legislation. Saphe is not liable for failure or delay in fulfilling obligations under the Terms, or for limited availability or functionality of the Services, where this is due to circumstances beyond Saphe's reasonable control. This may include legislation, government decisions or other unforeseen events beyond our control.

By submitting feedback, comments or content to Saphe, you grant Saphe a non-exclusive, royalty-free, worldwide licence to use, modify and distribute such content for the purpose of improving the Service. Saphe reserves the right to remove content that is unlawful, offensive or otherwise inappropriate.

User's Liability towards Saphe

You agree to indemnify and hold Saphe harmless from any claim, loss, liability or cost that may arise as a result of:

  • your failure to comply with these Terms,

  • your infringement of third-party intellectual property rights, or

  • any use or misuse of the Services that causes harm to a third party or constitutes a breach of applicable legislation.

8. Rights

Saphe may assign its rights and obligations under the Terms to any company under common control with Saphe. Saphe may also assign its rights and obligations to a third party in connection with a merger, acquisition, sale of assets or otherwise.

9. Force Majeure

Saphe is not liable for failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, strikes, pandemics, government intervention, power outages, internet outages or supplier failures.

10. Disputes

Any disputes or disagreements shall be resolved in accordance with Danish law, excluding Danish conflict of law rules. All disputes shall be finally resolved by the ordinary Danish courts.

If you are a consumer resident in the EU, you may — to the extent required by mandatory rules — bring proceedings before the courts of your country of residence.

11. Changes to the Terms

Saphe may amend the Terms without prior written notice if the changes are not to your detriment. If you do not wish to accept such changes, you may terminate the agreement in accordance with the applicable termination terms.

If the changes are to your detriment, you will be given at least 30 days' notice before the changes take effect. You will be notified via the Saphe Link app or via your registered email address.

Saphe may amend the Terms for reasons including:

  • The need to adapt the Services, including restructuring or changing features or subscription types.

  • Business reasons, for example relating to Saphe's administration of subscription agreements.

  • Market developments.

  • Legislation, orders or practice from courts, administrative authorities or complaints boards.

If you do not wish to accept the new Terms and Conditions, you must notify us before the changes take effect. If you notify us that you do not wish to be bound by the new Terms, we will regard this as termination of the agreement. If we do not hear from you, we will regard this as acceptance of the new Terms and Conditions.
